Enforcement Practices
If the Debtor cannot pay his debt to the party to whom he owes the debt and is seized, the creditor may impose a lien against the debtor, and in this case, deductions may be made from the debtor's monthly earnings. When a wage garnishment is imposed on an employee, it is the employer's responsibility to keep track of these deductions.

Executor: Enforcement will be applied personnel
File Type: Can be defined as "Enforcement" or "Alimony". The file type defined here is listed verbatim in the Interrupt definitions in the running summary. If there are both alimony and enforcement records for the employee, two separate enforcement records are created. Which lien item the deduction comes from can be tracked separately.
Priority: If there is more than one enforcement record belonging to the personnel, the collection priorities of the enforcements can be adjusted. For example; There may be two separate enforcements for the employee in the amount of 10,000 TL and 20,000 TL. Since the enforcement amount to be seized from the employee within the relevant month is determined by legal limits, whether the first deduction will be made from the enforcement of 10,000 TL or the enforcement of 20,000 TL can be adjusted according to the order of priority.
Enforcement Amount: It is the total enforcement amount to be applied to the personnel.
Previous Period Paid: An enforcement that is still ongoing when the employee enters the job. If a certain amount has been paid in previous periods, the amount entered in this field will be deducted from the person's total execution amount. The remaining enforcement calculation continues by calculating it as Total Amount - Previous Period Paid.
Enforcement Rate: This is the enforcement rate to be deducted from the net salary of the personnel for each month. It is generally applied as 1/4. Example; Net Wage x 0.25 = monthly deduction amount.
Account Type: Choose which account type the deduction will be made from. If there is more than one current account type belonging to the employee (such as Advance, Other Debts, Salary), which current account type the deduction will be reflected in is selected. Deductions can be monitored in the selected account on the employee statement.
Execution Date: Deductions start within the month of the date specified in this field.
IBAN to be paid: IBAN information of the person or institution that is in a creditor position due to enforcement.
Attention requirements:
- In the executions created in priority order, the system first deducts the first execution from the employee's net salary. The deduction rate of the first execution is made according to the definition specified in the definition "Execution Rate". The deduction to be made from the Second Enforcement amount is, after the first execution is cut, if there is still an amount that can be deducted from the net wage after the first deduction, it will be deducted according to the execution rate of the second execution. If it cannot make a deduction according to the rate in the execution rate of the second execution, a deduction will be made from the second execution as much as the maximum amount that can be deducted.
- In the last month of the First Enforcement payment, if this first enforcement can be closed with a deduction from the determined rate, the amount that can be transferred from the first execution can be transferred to the second execution.
- A fixed amount every month, such as alimony. If a deduction will be made in the following way, the amount to be deducted for each month is entered into the Execution Amount field and the execution rate is selected as 1/1.
- After a performance is recorded, the "Accept" box must be checked. Otherwise, it will not be reflected in the tally.
- If an enforcement is closed by the enforcement owner by paying the entire amount in cash, the enforcement record can be terminated by checking the "Manual Close" box.
- In the additional allowance definitions, it can be selected whether additional funds will be included in the enforcement deductions. If the additional allowance is defined as "Not Included in Execution", the enforcement deduction is made only on the net salary. If it is desired to include additional allowances in the executive deduction, the relevant box is not checked in the additional allowance definitions and in this case, the deduction is made by calculating the execution rate based on the net salary + net additional allowance amount.
Feedback
An enforcement record is created and followed up for cases where the personnel is in debt and the debt is not paid.
