Within the scope of the Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, it is stated that commercial messages to be sent by service providers to recipients cannot be sent without the consent of the recipient, except for the exceptions determined by the regulation, and that the recipients should be given the opportunity to reject the messages sent within the permission.

What is a commercial electronic message?

All kinds of commercial communication of real and legal persons through electronic communication tools, in order to promote and market their goods and services in line with their commercial activities or to increase the recognition of their business, is called commercial electronic messages. Commercial electronic messages that aim to increase the recognition of your business, such as congratulations, congratulations, or wishes, are also considered within the scope of commercial electronic messages.


Who is the Service Provider?

Within the framework of the law, calls, messages, e-mails, etc. Real and legal persons who provide commercial communication using tools are called Service Providers. All businesses and brands that do business in Turkey, want to communicate with their customers for marketing and promotional purposes, whether they are in the consumer market or doing commercial shopping with institutions in the B2B market, should enter this system.


How will you add your permissions to the Message Management System?

You can submit your permissions to the system individually or collectively with .csv files via iys.org.tr; You can add it via technical integration via IYS API. 


How Does It Work for Merchant Buyers, ie Businesses Doing Business in the B2B Market?

Individual buyer refers to the qualification of the buyer not acting on behalf of any business. Merchant buyer, on the other hand, refers to tradesmen, accountants, buyers, sales personnel, and similar commercial buyers who are affiliated with a business. A contact address can be registered in IYS both as an individual and as a merchant.

Pursuant to the legislation, prior approval is not required for commercial electronic messages sent to the electronic communication addresses of buyers who are merchants or tradesmen. However, traders and shopkeepers must be registered in the IYS before sending messages. In addition, if merchants and artisans exercise their right to refuse this communication, commercial electronic messages cannot be sent without their approval. For this reason, the data of merchant buyers must be recorded in the İYS before sending commercial electronic messages, due to the provision that "commercial electronic messages cannot be sent to buyers who do not have approval on the İYS" until May 31 and after. In these transfers, it is not obligatory for you to transmit permission data to merchant buyers about where and how you obtained the permission. However, after the transfer is canceled via IYS, you can no longer send electronic messages to the merchant recipient.
